FabX Innovations, Inc. ("FabX") warranty obligations for the product (the "Product") you have just purchased are limited to the terms set forth in this document. FabX warrants the Product against defects in materials and workmanship for a period ninety (90) days from the date of original purchase ("Warranty Period") when the Product is purchased through an authorized reseller or FabX product’s official website. If a defect arises and a valid claim is received by FabX within the Warranty Period, at its option, FabX will repair the Product or exchange the Product with a functionally equivalent new or refurbished product.
FabX warrants repaired Products and replacement products provided hereunder against defects in materials and workmanship from the date of the repair or replacement for ninety (90) days or, if longer, for the remainder of the Warranty Period. If the Product is exchanged, the replacement product becomes your property and the Product becomes FabX's property. When a refund is given, the Product becomes FabX's property.
Exclusions and Limitations
FabX's limited warranty applies only to the Product when purchased through an authorized reseller or FabX product’s official website. FabX warranty does not apply to items purchased from eBay or similar auction style merchants, or from merchants that are not authorized resellers or distributors of FabX products. The warranty does not apply to any non-FabX product, even if packaged or sold with the Product. The warranty excludes without limitation any scratching or surface damage to any non-FabX product, even if packaged or sold with the Product.
FabX shall not be liable for any special, incidental, indirect, punitive, or consequential damages for breach of any warranty of any type on this product. In addition to and without limiting the generality of the foregoing disclaimers, the limited warranty does not, under any circumstances, cover the replacement or cost of any electronic device or personal property inside or outside of the product.
This warranty applies only to the normal use of the Product, normal wear and tear excepted, in accordance with written use instructions, if any, provided with the Product (either in writing or through a hyperlink to such instructions). This warranty does not apply to damage caused by accident, abuse, misuse, or modification of the Product.
No Other Warranties
To the maximum extent permitted by law, this warranty and the remedies set forth above are exclusive and in lieu of all other warranties, remedies and conditions, whether oral or written, express or implied. FabX specifically disclaims any and all implied warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose. If FabX cannot lawfully disclaim or exclude implied warranties under applicable law, then to the extent possible any claims under such implied warranties shall expire on expiration of the warranty period. No FabX reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.
Damages Limitation
To the maximum extent permitted by law, FabX is not responsible for direct, or for special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including without limitation any costs of replacing personal property, or costs of recovering or reproducing any program or data stored in a device used with or carried in the FabX product.
Consumer Protection
For consumers who have the benefit of consumer protection laws or regulations in their country of purchase or, if different, their country of residence, that cannot be disclaimed as set forth above ("consumer laws"), the benefits conferred by this warranty are in addition to all rights and remedies conveyed by such consumer laws. To the extent that liability under such consumer laws may be limited, FabX's liability is limited, at its sole option, to replacement or repair of the product.
Obtaining Warranty Service
If you wish to make a claim under this warranty with respect to the Product, go to www.shopfabx.com and download the warranty claim form. You can also email us at support@shopfabx.com and we will send you the claim form.
> How to process a warranty claim:
Submit your claim form to support@shopfabx.com to initiate your claim. Please have your order number and/or proof of purchase referred or attached to the claim form. Once we have reviewed your claim (typically within seven working days), an RMA (Return Merchandise Authorization) number will be issued to proceed with the warranty claim.
FabX will request for the damaged product sent to the following address (customer is responsible for the costs to ship the damaged product back to FabX):

NOTE: Please indicate RMA number on the package. Any packages returned without an RMA number are subject to be returned to sender. We highly recommend using a shipping method that offers package tracking. FabX will not be responsible for return shipments lost or damaged in transit.
Once the damaged product is received by FabX and the warranty claim has been approved, a replacement order will be issued. In the event the warranty claim is denied, FabX will inform customer. Customer will be responsible for the charges for the replacement order if replacement is sent and no refund will be issued.
All warranty replacements are shipped USPS First Class postage method unless otherwise requested. Customers may request to expedite shipment of the replacement item. Additional shipping charges may apply for expedite shipping. To process this expedite shipping, the customer's credit card may be charged for the full amount of the warranty item. A credit will be issued back to the card (less any expedited shipping and handling charges).
